1. Overview

These Terms of Service (“Terms”) govern your access to and use of the Pijimo website, online store, products, content, features, tools, and services (collectively, the “Services”).

The Services are operated by Evegone Mülk Yönetim Limited Şirketi (“Pijimo,” “we,” “us,” or “our”), a company registered in Türkiye.

By accessing or using the Services, you agree to these Terms.

If you do not agree with these Terms, you should not use the Services.

These Terms should be read together with our:

  • Privacy Policy;

  • Refund & Return Policy; and

  • Shipping Policy.

Where mandatory consumer law applies to your purchase, those statutory rights prevail over any conflicting provision of these Terms.

2. Eligibility

Pijimo products are collectible art objects intended for collectors aged 14 and older.

By using the Services or placing an order, you represent that you are legally capable of entering into a binding agreement under the laws applicable to you.

If you are under the age required to enter into a purchase contract in your jurisdiction, you should use the Services only with the involvement and authorization of a parent or legal guardian where required.

3. Pijimo Universe and Products

Pijimo is an ongoing collectible art universe consisting of collectible art objects and characters.

The first permanent Pijimo character is ADAM.

Future characters may be introduced as permanent additions to the Pijimo Universe.

Pijimo may also release special, temporary, limited, collaborative, commemorative, or otherwise distinct editions or variations from time to time.

The release structure, availability, quantity, materials, colors, markings, and other characteristics of a particular product or special release may vary.

Unless expressly stated otherwise on the applicable product page, the existence of a particular Pijimo character does not guarantee that every possible variation of that character will always be available for purchase.

4. Blind Boxes

Certain Pijimo products are sold in Blind Box packaging.

A Blind Box means that the specific collectible variation contained inside the package is not disclosed before opening.

Depending on the applicable product, the undisclosed variation may include a plush colorway or another collectible variation.

The Blind Box format is an intentional part of the Pijimo product experience.

Purchasing a Blind Box does not guarantee receipt of:

  • a particular plush colorway;

  • a particular variation;

  • a preferred appearance; or

  • a particular rarity,

unless expressly stated otherwise in the applicable product description.

Not receiving a preferred variation does not, by itself, constitute a product defect.

The Blind Box nature of a product may also affect eligibility for returns or refunds as described in our Refund & Return Policy.

5. Product Appearance and Natural Materials

Pijimo products use natural materials, including solid beech wood.

Because wood is a natural material, individual products may contain variations in:

  • grain;

  • color;

  • tone;

  • texture; and

  • natural markings.

These characteristics are inherent to natural wood and contribute to the individual character of each product.

Minor natural variations that do not affect the product's structural integrity or conformity with its description are not considered manufacturing defects.

Product photographs, videos, renders, and other visual materials are intended to provide a representation of the product.

Minor variations may occur between promotional materials and individual products.

Where a product includes handmade or human-applied finishing or assembly, minor differences resulting from the production process may also occur, provided that the product remains materially consistent with its description.

6. Orders and Acceptance

Placing an order constitutes an offer to purchase the selected products.

An order confirmation acknowledges receipt of your order but does not necessarily constitute acceptance of the order where acceptance is required at a later stage.

We reserve the right to refuse or cancel an order where reasonably necessary, including where:

  • a product is unavailable;

  • a material pricing or listing error has occurred;

  • payment cannot be verified;

  • fraud or unauthorized activity is suspected;

  • shipping to the destination is legally or operationally unavailable; or

  • circumstances beyond our reasonable control prevent fulfillment.

If we cancel an order after payment has been received, we will refund the amount paid for the cancelled order, subject to applicable law.

7. Pricing

Pijimo currently offers its products using an all-inclusive customer pricing model.

Unless expressly stated otherwise on the applicable product page or at checkout, the displayed purchase price is intended to cover:

  • the Pijimo product;

  • international shipping; and

  • applicable taxes, duties, or import charges associated with delivery to the stated destination.

The exact treatment of taxes, duties, and other charges may depend on the destination, applicable law, customs requirements, and the checkout configuration applicable to the order.

Pijimo may change product prices from time to time.

A price change will not affect orders already placed and paid for.

8. Shipping and Delivery

Our target delivery timeframe is approximately four weeks from the date an order is placed.

This is an estimated target rather than a guaranteed delivery date unless expressly stated otherwise.

Delivery times may vary because of:

  • customs processing;

  • transportation;

  • carrier operations;

  • international logistics;

  • weather;

  • public holidays;

  • incorrect or incomplete delivery information; and

  • other circumstances outside our reasonable control.

Our Shipping Policy provides additional information regarding delivery, customs, tracking, lost shipments, address accuracy, and related matters.

Where applicable law provides mandatory rights or remedies for shipping delays, Pijimo will comply with those requirements.

9. Returns and Refunds

Returns, refunds, defective products, damaged products, and Blind Box return conditions are governed by our Refund & Return Policy.

Nothing in these Terms limits mandatory consumer rights.

10. Intellectual Property

All content made available through the Services, including:

  • Pijimo names;

  • logos;

  • trademarks;

  • product designs;

  • character designs;

  • artwork;

  • illustrations;

  • photographs;

  • packaging designs;

  • text;

  • graphics;

  • videos;

  • website design;

  • product concepts; and

  • other original materials

is owned by or licensed to Pijimo and is protected by applicable intellectual property laws.

Purchasing a Pijimo product does not transfer ownership of Pijimo's intellectual property to the purchaser.

Except where expressly permitted by law or with our prior written permission, you may not:

  • reproduce Pijimo products or designs;

  • manufacture copies;

  • create derivative commercial products based on Pijimo designs;

  • commercially exploit Pijimo artwork or designs;

  • reproduce Pijimo packaging or branding;

  • use Pijimo trademarks in a manner that suggests authorization or affiliation; or

  • represent yourself as an official Pijimo representative, distributor, licensee, or partner.

Nothing in this section prevents lawful personal use, display, resale, commentary, review, or other activity protected by applicable law.

11. Collector Ownership and Resale

You may resell a genuine Pijimo product that you lawfully own, subject to applicable law.

However, resale does not grant you any right to:

  • reproduce the product;

  • manufacture copies;

  • create competing products using Pijimo intellectual property;

  • use Pijimo intellectual property to manufacture or market unauthorized merchandise;

  • represent yourself as an authorized Pijimo distributor;

  • use Pijimo branding in a way that creates confusion regarding affiliation; or

  • imply that Pijimo endorses a resale transaction unless we have expressly authorized that representation.

12. Reviews and User Content

If you submit reviews, photographs, comments, suggestions, or other content to Pijimo (“User Content”), you represent that you have the right to submit that content.

You grant Pijimo a non-exclusive, worldwide, royalty-free license to use, reproduce, display, publish, adapt, and distribute User Content for purposes including:

  • operating the Services;

  • improving the Services;

  • displaying customer reviews;

  • promoting Pijimo;

  • marketing Pijimo products; and

  • developing related content.

This license continues only for as long as reasonably necessary for these purposes, subject to applicable law and any rights you may have to request removal of your content.

We may remove User Content that violates applicable law, infringes third-party rights, or violates these Terms.

13. Prohibited Uses

You may not use the Services to:

  • violate applicable law;

  • infringe intellectual property rights;

  • engage in fraudulent activity;

  • interfere with the security or operation of the Services;

  • introduce malicious code;

  • impersonate another person or entity;

  • attempt unauthorized access to accounts or systems;

  • misuse payment systems;

  • scrape, crawl, or systematically extract website content in a manner that violates applicable law or materially interferes with the Services; or

  • engage in conduct that could reasonably cause substantial harm to Pijimo, its Services, or other users.

14. Third-Party Services

The Services may rely on or integrate with third-party services, including Shopify, payment providers, logistics providers, fulfillment providers, analytics services, communication services, and advertising platforms.

Third-party services may be subject to their own terms, conditions, and privacy policies.

Pijimo is not responsible for the independent acts or omissions of third-party services outside our reasonable control, except to the extent required by applicable law.

15. Shopify

Pijimo is powered by Shopify.

Your purchase is made directly with Pijimo, not with Shopify.

Shopify provides the technology and ecommerce infrastructure used to operate the online store.

Shopify is not the seller of Pijimo products and is not responsible for the products sold by Pijimo or for the fulfillment of your purchase.

Shopify may process information in connection with providing its services in accordance with its applicable terms and privacy documentation.

16. Availability of the Services

We do not guarantee that the Services will always be available, uninterrupted, secure, or error-free.

We may modify, suspend, restrict, or discontinue parts of the Services where reasonably necessary, including for maintenance, security, operational, legal, or business reasons.

Nothing in this section limits rights that cannot legally be excluded.

17. Product Availability and Special Releases

Pijimo is designed as an ongoing collectible art universe.

Permanent Pijimo characters may remain available as part of the continuing product collection, subject to stock availability, production capacity, product updates, and other operational circumstances.

Pijimo may also introduce:

  • special colorways;

  • rare variations;

  • commemorative releases;

  • collaboration products;

  • event-specific releases;

  • limited editions; or

  • other temporary or limited products.

Such special releases may be available only for a limited period or in limited quantities.

Unless expressly stated otherwise, purchasing a Pijimo product does not create a contractual right to future production, continued availability, a particular future character, or any specific collectible variation.

Changes to future product availability do not create a right to a refund for a genuine product that has already been correctly supplied, subject to applicable consumer law and our Refund & Return Policy.

18. Pricing and Listing Errors

Although we make reasonable efforts to ensure that product information, descriptions, images, and prices are accurate, errors may occasionally occur.

If a material pricing or listing error is identified before fulfillment, we may contact you to clarify the correct information or cancel the affected order and issue a refund where appropriate.

We will not intentionally charge an amount materially different from the price presented to you without your agreement, except where permitted or required to correct an obvious error under applicable law.

19. Limitation of Liability

To the maximum extent permitted by applicable law, Pijimo will not be liable for indirect, incidental, special, or consequential losses arising from use of the Services.

However, nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for:

  • fraud;

  • intentional misconduct;

  • death or personal injury where liability cannot lawfully be excluded;

  • defective or non-conforming goods where mandatory consumer protections apply; or

  • other statutory rights or liabilities that cannot legally be limited.

Nothing in these Terms limits statutory rights concerning defective, damaged, or non-conforming goods.

20. Indemnification

To the extent permitted by applicable law, you agree to be responsible for losses reasonably arising from:

  • your unlawful use of the Services;

  • your infringement of third-party rights; or

  • your material violation of these Terms.

This provision does not apply to the extent that applicable law prohibits or limits such obligations.

21. Privacy

Personal information collected through the Services is handled in accordance with our Privacy Policy.

Our Privacy Policy explains how we collect, use, disclose, retain, and otherwise process personal information.

22. Communications

By placing an order, you agree that Pijimo may contact you regarding:

  • your order;

  • payment;

  • shipping;

  • customs;

  • delivery;

  • returns;

  • refunds;

  • customer support; and

  • other transactional matters.

Marketing communications are subject to applicable consent, notification, and opt-out requirements.

23. Electronic Communications

You agree that communications with Pijimo may be provided electronically, including by email or through the Services, where permitted by law.

Electronic communications may satisfy legal requirements for written communications where applicable.

24. Changes to These Terms

We may update these Terms from time to time to reflect changes to:

  • our Services;

  • our products;

  • our business practices;

  • technology; or

  • applicable legal requirements.

Updated Terms will be posted on this page with a revised “Last updated” date.

Changes will not retroactively alter rights or obligations relating to orders already placed except where required or permitted by applicable law.

25. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, and the remaining provisions will continue to apply to the extent permitted by law.

26. No Waiver

Our failure to enforce a provision of these Terms does not constitute a waiver of our right to enforce that provision later.

27. Governing Law and Mandatory Consumer Rights

These Terms are generally governed by the laws of Türkiye, without regard to conflict-of-law principles.

However, if you are a consumer residing in a jurisdiction whose mandatory consumer protection laws apply to your purchase, those mandatory rights remain applicable.

Nothing in these Terms is intended to deprive you of protections that cannot legally be excluded under the law applicable to your transaction.

Where a mandatory consumer dispute-resolution mechanism, court jurisdiction, or other statutory procedure applies, your rights under that law remain unaffected.
